Bridge appeals U.S. demolition order - Invest Windsor Ontario Real Estate

February 26, 2010

Lawyers for Ambassador Bridge owner Matty Moroun have filed another appeal seeking to delay the court-ordered demolition of his dutyfree store, gas pumps and toll booths on the Detroit side of the bridge.

Judge Prentis Edwards denied a stay order Friday forcing the bridge to proceed with the demolition.

Edwards ruled Feb 1 that the bridge must appoint someone within 21 days to oversee demolition and present a timetable for removal of the structures.

He ruled they were built in violation of a government agreement and on city property.

Bridge company lawyers last week appealed the original decision to the Michigan Court of Appeals and have now also appealed Friday's decision to the same court.

"This Court's immediate intervention is required in order to effectuate (the bridge company's) right to seek appellate review of a plainly erroneous and potentially catastrophic order," said court documents filed by Moroun's lawyers and obtained Tuesday by The Star.
